Honda in conjunction with the National Highway Traffic Safety Administration (NHTSA) has issued a recall of nearly 46,000 Odyssey minivans. The recall affects vans that are 2008-2009 model years that are equipped with a power liftgate system. There is an issue with the rear hatchback that may result in injury.

It was reported that the struts in the back door that aid with raising and supporting the power liftgate can fail because of a manufacturing flaw. The NHTSA report explained that, "Struts with diminished performance can lead to unexpected closure, increasing the risk of personal injury."

The New York Post reported that Honda is aware of two incidents that resulted in minor injuries. To remedy the situation, Honda will be contacting owners of the affected minivans and the struts and the power liftgate will be replaced by their local dealer free of charge. Efforts to enact the recall are set to begin on or around March 13.

The recall also reported that owners may contact Honda's Customer Service by calling (800) 999-1009, or can contact the NHTSA by calling (888) 327-4236 or online at www.safecar.gov.

The NHTSA explains on their website that there are two types of recalls with regards to motor vehicles. They can either be preemptively enacted by the car manufacturer themselves or ordered by the NHTSA. Whenever a vehicle recall is issued the manufacturer is required to release information to the public including, "safety-related defect or noncompliance with a Federal motor vehicle safety standard, the involved vehicle/equipment population, the major events that resulted in the recall determination, a description of the remedy, and a schedule for the recall."

If your vehicle has been or ever is recalled you can rest assured that the problem will be remedied by the manufacturer at no cost to you. Car companies are also required to attempt the owners of any affected vehicles by using their own records of purchase along with the state vehicle registration.

The site also explained that the Safety Act in place with regards to recalled vehicles or parts does not require compensation for any damage or injury that results from the recalled item. While it is not a requirement, they went on to explain that owners can seek compensation privately. In order to do this, owners should speak with a qualified New Jersey car accident attorney in order to find out their legal rights and options.

If your vehicle has been recalled and you have any issues receiving correct repair or having the problem fixed free of charge you can contact the NHTSA and they will assist you in making sure you get the correct repairs at no cost.
