Two people sustained injuries in a San Bernardino car accident after two cars collided at a Joshua Tree intersection. The Hi Desert Star reports that the vehicles were involved in a broadside collision at the intersection of Hill View Road and Twentynine Palms Highway, the morning of March 16, 2010. California Highway Patrol officials said that Brianna Batross, who was driving an Audi sedan failed to yield right-of-way to a Pontiac minivan going east on the highway, which was driven by Michelle Lamore. Both Lamore and her passenger were taken to a nearby hospital. However, their injuries were not life-threatening.
Broadside crashes can be devastating. Considering the manner in which this crash occurred, it is indeed fortunate that no one sustained catastrophic injuries here. I wish Lamore and the other injured victim the very best for a quick and full recovery.
San Bernardino Car Accidents
There were 107 deaths and 1,925 injuries involving car accidents in the unincorporated areas of San Bernardino County, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). Also, in San Bernardino County as a whole, car accidents claimed 263 lives and caused 8,504 injuries, in 2008.
Who Had the Right-of-Way?
Based on this news report, officials are saying that Lamore had the right-of-way at the intersection in this case. According to California Vehicle Code section 21800 (a): "The driver of a vehicle approaching an intersection shall yield right-of-way to any vehicle, which has entered the intersection from a different highway."
If Batross is determined to have been at fault for this accident, she could be held liable for the collision and resulting injuries. If there was a dangerous condition on this roadway, which caused or contributed to this accident, the city or governmental agency responsible for maintaining that roadway could also be held liable. Any such claim against a governmental entity in California must be filed within 180 days of the accident or injury.
In such cases, it would be in the best interests of injured victims to get in touch with a reputed California personal injury lawyer, who will make sure that they are fairly compensated for their injuries, damages and losses.
