A 50-year-old man, who was killed in a car accident in Los Angeles after being struck by a vehicle on the 210 Freeway the night of August 27, 2010, has been identified as Kevin Payne. The San Gabriel Valley Tribune reports that Payne was standing on the shoulder of the freeway in Glendora next to his Mercedes while having his disabled pickup truck hooked on to a tow truck.

The Mercedes was struck by a Dodge van, whose driver, 36-year-old Toby Okleshen, may have suffered a diabetic attack, officials say. The Mercedes in turn hit Payne who sustained fatal injuries. Officials are still talking to witnesses and conducting an investigation.

My heartfelt sympathies go out to everybody who knew and loved Kevin Payne. Please keep this grieving family in your prayers.

Pedestrian Accidents

One death and 13 injuries were reported as a result of pedestrian accidents in Glendora, according to CHP's 2008 Statewide Integrated Traffic Records System (SWITRS). In Los Angeles County, 214 people died and 4,985 were injured as a result of pedestrian accidents in 2008.

Causes and Compensation Issues

If the details of this news report are accurate, officials are saying that a medical condition, not alcohol or drugs, caused this tragic crash. However, if Okleshen is determined to have been at fault, he could be held liable for Payne's wrongful death. In cases where negligence or wrongdoing is involved, families of deceased victims can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced Los Angeles personal injury lawyer, will be able to advise victims' families in such cases about their legal rights and options.
