Two Sustain Injuries in Orange Car Accident
Two women were injured in an Orange County car accident after one vehicle crossed into opposing traffic lanes and struck another, the afternoon of January 28, 2010. The Orange County Register reports that the accident occurred when the 24-year-old driver of a Buick who was traveling east on Santiago Canyon Road veered into opposing traffic lanes and collided head-on with a Porsche Cayenne. Police said that the driver of the Buick had to be extricated from her vehicle and was transported to a local hospital with critical injuries. The driver of the Porsche, identified only as a 33-year-old woman, was also hospitalized with injuries.
I sympathize with both these injured victims. I wish them the very best for a speedy and full recovery. They will be in my prayers.
Car Accidents
According to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS), there were 10 fatalities and 814 injuries involving car accidents in Orange. Countywide, 178 deaths and 14,185 injuries were reported as a result of car accidents in 2007.
Causes and Liability Issues
If the details of this news report are accurate, the driver of the Buick lost control of her vehicle and slammed into the Porsche. However, the question here is why the driver of the Buick lost control and crashed. Was there a vehicle defect, which caused the driver to lose control? It may have been the result of driver error or a dangerous condition on the roadway as well.
In such cases, the at-fault driver could be held liable for the accident and resulting injuries. If a vehicle defect caused this accident, the auto maker could be held responsible. Or if the accident was caused as a result of a dangerous or defective roadway, the city or governmental agency responsible for maintaining that roadway could be held liable as well. Please remember that any such claim against a California governmental agency must be filed within 180 days of the accident or injury. An experienced Orange County personal injury lawyer will be able to advise victims and their families about their legal rights and options.
