It appears that a moped rider in San Diego may have suffered catastrophic injuries in an accident the morning of May 12, 2010. The San Diego Union-Tribune reports that the moped was struck by another vehicle near the intersection of Otay Center Driver and Siempre Viva Road in the Otay Mesa area. The rider of the moped was taken to a local hospital with serious head injuries, police said. No one has been cited or arrested pending an official investigation.
My heart goes out to the injured victim and his family for what they are going through at this time. I pray for the victim's quick and complete recovery.
San Diego Car Accidents
In San Diego County, 246 fatalities and 13,527 injuries were reported as a result of car accidents in 2008, according to CHP's traffic accident statistics. Also, 81 people died and 6,123 were injured as a result of San Diego car accidents during the same year.
Fault and Liability
Based on this news report, we do not know the cause for this collision. It is not clear where the moped rider was riding at the time of the collision. It is also important to look into who had the right-of-way at the time and whether the driver of the other vehicle was impaired or distracted. In some cases speeding or reckless driving can also cause these types of collisions. I trust officials are examining all the circumstances of the collision in order to determine what exactly occurred here.
If it is determined that the driver of the car was at fault, he or she could be held liable for the accident and resulting injuries. Injured victims in such cases can seek compensation to cover all medical costs, loss of wages, pain and suffering and other related damages. Victims would be well-advised to seek the counsel of an experienced San Diego personal injury lawyer who can advise them about their legal rights and options.
