javier's jeep was towed away at the scene and taken to a place in indio where my father signed away any interest in the car because it was totaled. they charged my dad a fee that would cover the jeep being disposed of. in this case, is there really nothing that can be done regarding the vehicle manufacturer being held liable at all?

i am javier's sister. my brother was wearing his seat belt, i was told by the doctor who i'm guessing received this information from the police officer who was at the scene. they say that his seat was not in a proper position and it leaned far back during the accident which caused my brother to be ejected from his jeep. can the car manufacturer be held liable for something like that? thank you for your time.
