Pedestrian is Victim of San Francisco Hit-and-Run Collision
Juan Francisco Navarro Flores, 25, was killed in a San Francisco car accident after he was struck by a vehicle on the Sierra Point Parkway off-ramp in Brisbane. The driver did not stop. People who saw the accident stopped and called emergency personnel. However, Flores was pronounced dead at the scene. No further information is available about the hit-and-run suspect or the vehicle. An investigation is ongoing.
I offer my deepest condolences to Flores' family for their profound loss. His grieving family members will remain in my thoughts and prayers.
Hit-and-Run Statistics
California Highway Patrol's traffic accident statistics show that there were 17,158 hit-and-run collisions that resulted in fatalities or injuries in California, in 2008. A majority of these were injury collisions. Also, 247 people were killed in 2008 due to hit-and-run crashes statewide.
Pedestrian Laws
Leaving the scene of an accident or hit-and-run is a serious crime under California Vehicle Code 20001 (a). In this case, it is not clear whether the pedestrian was in a crosswalk. California Vehicle Code Section 21950 states: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection." The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk "shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian."
Liability Issues
In cases where negligence or wrongdoing is involved, families of deceased car accident victims would be well-advised to contact a reputed San Francisco personal injury lawyer who will advise them about their legal rights and options. In such cases families could file a wrongful death claim against the negligent parties seeking compensation to cover funeral expenses, lost future income, loss of love and companionship, and other related damages.
