An October 13, 2009 Orange County car accident killed Vert Mooney, 78, after the car he was driving left the roadway and fell into a ditch in San Juan Capistrano. According to The Orange County Register, Mooney had been driving a Honda CRV on the Junipero Serra Road off-ramp near the southbound on I-5 when the car hit a freeway wall and drove down the side of a ditch. The Honda then crashed head-on into a tree. Orange County fire officials, who responded to the incident, declared Mooney dead at the scene of the crash.

California Highway Patrol officials, who are investigating the accident, say Mooney may have fallen asleep while driving. Anyone with more information about the accident or those who may have witnessed it are asked to call CHP's San Juan Capistrano office at 949-487-4000.

My prayers are with the family and friends of Vert Mooney, the car accident victim, for their tremendous loss. I offer my deepest and heartfelt condolences to all those who knew and loved this man.

Orange County Car Accident Causes

There are of course, a number of reasons for a car accident such as this one occurs. While it is possible Mooney fell asleep and lost control of his car, I'm inclined to believe there may be other explanations. Did dangerous road conditions lead to this fatal accident? Was there any debris present on the road from which Mooney had tried to steer away? Did another car force the Honda off the road? I trust investigators are looking into these questions and more.

Bringing In An Experienced California Personal Injury Lawyer

The Mooney family would be well-advised to contact a reputed Orange County personal injury lawyer, who will stay on top of the official investigation and determine if there was any negligence involved here. Often CHP officials do not have the time or resources to explore all the angles in such a case. Mooney's family has suffered a horrific loss and deserves to know what happened. A knowledgeable attorney will determine if a defective roadway caused or contributed to Mooney's death. If that should be case, then the governmental agency responsible for maintaining that roadway may also be held liable. California Government Code states that any such claim against a governmental agency must be filed with six months of the accident or injury.
