Authorities in Sacramento say that a DUI collision likely caused the death of 49-year-old Robert Alverson, who was struck by a vehicle on Highway 99 the morning of May 14, 2010. The Sacramento Bee reports that the fatal accident happened near Mack Road when Alverson had got off his vehicle to help people at the scene of a multi-vehicle accident. He was trying to cross the northbound lanes of the highway on foot when he was struck and killed. California Highway Patrol officials say the driver who struck Alverson was intoxicated, but they have not determined if he was at fault or if he will be facing charges.

There were eight deaths and 240 injuries in Sacramento involving pedestrian accidents in 2008, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). Countywide, 20 people died and 481 were injured as a result of pedestrian crashes during the same year.

It is illegal for any driver in California to operate a motor vehicle with a blood alcohol level of 0.08 percent or higher. According to California Vehicle Code Section 23152 (a): "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." Usually, a driver under the influence who caused a fatality, either to a passenger, pedestrian or another motorist, is likely to face gross vehicular manslaughter charges. But, in this case, officials are still investigating whether the driver caused the accident or if he could have avoided it.
